The decision that the fish you have described is indeed the same species as the one earlier described is a taxonomic decision. The Code doesn't deal with those decisions.

I understand, but the code establish the subjective synonymy of the species and for this to happen somebody has to declare it, i agree there are no guidelines for the declaration but a no declaration can not be taken as a declaration, at least in my crc editorial view

In the current issue of DCG-Informationen there is a contribution about Labeotrophaeus chlorosiglos. Staeck [1] gives additional support for the recognizing it as an independent lineage which deserves a scientific name. I’m thinking the arguments given therein are also valid for the case Labeotropheus simoneae.
